At the moment in Belarus it is quite common for the Companies, especially Companies with foreign investments (or representative offices of foreign organizations) to hire foreign citizens who are qualified professionals, including senior management staff (CEO, CFO, etc.).

If there is such a need, a number of issues to be resolved inevitably arise: ranging from the necessity of implementing administrative procedures for the legal employment of foreign citizens to the issues of obtaining documents for the long-term residence of such foreign employees (members of their families) in Belarus.

It should be noted that within the framework of migration law subpractice, lawyers of Lovtsov Klochko & Partners provide legal services covering the whole range of issues occurring in situations similar to the described above, namely, providing verbal and written advice, drafting the necessary documents, legal support and/or representing the Clients’ interests in the relevant state bodies and institutions.

Key activities:

  • Obtaining a special permission for employment of a foreign citizen (stateless person) in the Republic of Belarus;
  • Drafting of employment agreements (contracts) with foreign employees (including senior managers);
  • Registration of employment agreements (contracts) with foreign employees in the territorial offices on citizenship and migration;
  • Legal review of the employment agreements (contracts) with foreign employees used by the Client, identification of the existing risks and drawing up the proposals for their elimination;
  • Drawing up the corporate documentation (minutes of meetings of participants (shareholders), decisions of the founders) on the election of a senior manager being a foreign citizen;
  • Drawing up organizational/administrative and other documentation related to the recruitment of foreign employees (position descriptions and work instructions, orders, etc.);
  • Registration of foreign employees' personal files;
  • Obtaining a permit for recruitment of foreign labour in the Republic of Belarus in the Department of Citizenship and Migration of the Ministry of Internal Affairs of the Republic of Belarus (when it comes to hiring more than 10 foreign workers);
  • Registration of foreign employees’ stay in the territory of the Republic of Belarus in the territorial bodies on citizenship and migration;
  • Obtaining a temporary residence permit for a period of up to 1 year in the territorial offices on citizenship and migration;
  • Obtaining visas of the Republic of Belarus (including multiple exit/entry visa for a period of up to 1 year) for foreign employees in territorial bodies for citizenship and migration.

The provision of legal services is paid on the basis of the cost and pricing principles previously agreed with the Client, namely: either on the basis of a fixed cost of services, or on the basis of a “budget” determining the allowable minimum and maximum cost limits, or on actual labour costs.

Payments are carried out on the basis of an invoice as well as Certificate of services rendered (if payment is made upon completion of the services rendering).
